Social, political, and personal\ncrises will continue to impact students and our learning communities,\nclassrooms, and workplaces. We want you to have as much support as possible in\naddressing student behaviors that cause concern or result in disruption.&nbsp;<\/p>\n\n\n\n<p>We care about you and your safety. In spring 2019,&nbsp;Academics&nbsp;instituted a process for\nsupporting targeted staff and faculty (attached). In the case of ongoing mental health needs,\nStudent Wellness staff refer students to other community resources.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In support of equity and in compliance with laws pertaining to ADA\nprotections, mental health dynamics cannot be used to exclude students from\neducational opportunities, programs, or services. Situations which involve\nbehavior in violation of the Student Conduct Code can be adjudicated. In these\nsituations, efforts are made to work with students to support voluntary action\nwhen possible and appropriate.&nbsp;<\/p>\n\n\n\n<p><strong>CARE team.&nbsp;<\/strong>Many of you already use the&nbsp;<a href=\"https:\/\/nam02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.evergreen.edu%2Fcare%2Fcare-campus-assessment-response-evaluation-team&amp;data=04%7C01%7Cwilliaas%40evergreen.edu%7Cb45ebd1b5ab044576cb408d906938e8b%7C22adcff7c06f49a68f2050711c40ddaa%7C0%7C0%7C637548053829733543%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=PjB%2BAs92nsQkVvgC16K40HinJAwyTD6rSJidrs6t%2B%2Bw%3D&amp;reserved=0\" target=\"_blank\" rel=\"noreferrer noopener\">CARE team reporting system<\/a>&nbsp;to solicit support for students who are struggling\nacademically, behaviorally, or personally. The CARE team is made up of staff\nand administrators from across departments who take a collaborative approach to\naddressing student issues.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Student rights&nbsp;and&nbsp;responsibilities.<\/strong>&nbsp;Student\nbehavior which is prohibited at Evergreen is outlined in the&nbsp;<a href=\"https:\/\/nam02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.evergreen.edu%2Fsites%2Fdefault%2Ffiles%2FCode%2520of%2520Student%2520Rights%2520and%2520Responsibilities_0.pdf&amp;data=04%7C01%7Cwilliaas%40evergreen.edu%7Cb45ebd1b5ab044576cb408d906938e8b%7C22adcff7c06f49a68f2050711c40ddaa%7C0%7C0%7C637548053829733543%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=oeIBOKQ4taqGTp9GFxM0wIArVyYJ7sUrL9%2FCxvWhf1U%3D&amp;reserved=0\" target=\"_blank\" rel=\"noreferrer noopener\">Code of Student Rights &amp;\nResponsibilities (Code).<\/a>&nbsp;Reports\nof possible Code violations can be made directly to Student Rights &amp;\nResponsibilities (SRR), which manages complaints about students\u2019 behaviors\nwhich may have violated the Code.&nbsp;The\nflow chart attached explains the process of interacting with the Code, but here\nare some other elements to consider when you are deciding on your response to a\nparticular situation:&nbsp;&nbsp;<\/p>\n\n\n\n<ul><li>Evergreen\u2019s\n     resource for immediate emergency response is the police; for imminent threats of harm\n     to self or others,&nbsp;please&nbsp;contact dispatch at&nbsp;(360) 867-6140 or call 911.&nbsp;<\/li><li>For\n     student behavior which is seriously disruptive to an academic session,\n     educational program, the teaching\/learning environment&nbsp;generally, or to college work,&nbsp;please&nbsp;inform the student&nbsp;that&nbsp;you are requesting they\n     stop the behavior and\/or leave the session\/office. The student needs to be\n     informed by you or SRR to follow up with SRR before the student\u2019s return.\n     The student\u2019s behavior needs to be reported to SRR&nbsp;for adjudication via the\n     Code.&nbsp;&nbsp;<\/li><li>For\n     less serious behavior that may be a Code violation, you can intervene\n     directly and refer the student to SRR for adjudication via the Code.&nbsp;<\/li><li>For\n     behaviors which do not rise to the level of a Code&nbsp;violation,&nbsp;and which are still\n     problematic, the strongest tool is the process of discussion and\n     expectation-setting, documentation, and notice to the student that same or\n     similar behavior will be referred to SRR. This process enables SRR to\n     address repeat behavior&nbsp;(after&nbsp;the student has been&nbsp;warned)&nbsp;as \u201cnon-compliance\n     with a college official\u201d via the Code.&nbsp;&nbsp;&nbsp;&nbsp;<\/li><\/ul>\n\n\n\n<p><strong>Establishing expectations.<\/strong>&nbsp;Faculty\nand staff are advised to place language addressing expectations for student\nbehavior in syllabi and program\/course agreements, student employment and\nvolunteer descriptions, and workplace\/community agreements. This is a crucial\nstep in helping students understand what reasonable behavior is by setting\nclear expectations for appropriate engagement and by providing direct feedback\nas needed.&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>As you develop agreements\/expectations, please be aware that\nremoving a student\u2019s access to an educational\/programmatic opportunity,\nservice, or office requires a referral to SRR so the student\u2019s behavior can be\naddressed through the Code&nbsp;and\nso the decision to temporarily separate a student from an educational\nopportunity or service can be supported with due process protections.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Permanently separating a student from an academic or educational\nprogram or office, or college service is a strategy of last resort requiring\nsignificant documentation of non-compliant, disruptive,&nbsp;harmful,&nbsp;or\nother behavior which violates the Code.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Free speech.<\/strong>&nbsp;Evergreen\u2019s&nbsp;<a href=\"https:\/\/nam02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.evergreen.edu%2Fstudentaffairs%2Ffree-speech-guide&amp;data=04%7C01%7Cwilliaas%40evergreen.edu%7Cb45ebd1b5ab044576cb408d906938e8b%7C22adcff7c06f49a68f2050711c40ddaa%7C0%7C0%7C637548053829743501%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&amp;sdata=DB3ZP4P5wUYCLBrPLmINCYHCdzYGVYkV40niwwbCSGQ%3D&amp;reserved=0\" target=\"_blank\" rel=\"noreferrer noopener\">Free Speech Guide<\/a>&nbsp;may be useful in clarifying protected speech vs. unprotected\nspeech.
